What Should I Do Next To Get My Security Deposit Back?
I moved out of my last rental on Long Island NY on June 13th (I paid up to the 15th, however). We ALWAYS paid our rent on time and we lived there for 15 months. The first year was a lease and then we went month to month after that. A few months before we moved we started to have issues with the house. Everytime we used the washer, the shower would back up raw sewage. I called the landlord, and at first he said he send someone over to look at it. He never sent anyone, and then started to avoid my calls. When I did finally get in touch he’d again said he’d send someone, but no one ever showed. Finally I gave up. I had to either wash my clothes at a laundry mat or clean up raw sewage. So…I moved out on schedule and even paid a cleaning lady $100 to have a final cleaning done of the house. I then proceeded to video tape the house. There is no damage at all. The house looks a lot better than it did when we moved into it. But now I have a security deposit issue. My landlord lives in Ma. I now live in Va. I have had to call him numerous times to find out where my security deposit is. He owes us $1000 (it was originally $2000, but he allowed us to use $1000 of the security for the last 15 days of rent). I called him once I was settled in Va and asked him if he had our new address to send the security, and he said he got it and he’d put a check in the mail the following Monday (that was 3 weeks ago). Then I called back and told him I never got it after waiting a week. He said “Oh, I had the wrong address for you”, and I again gave him my new address and even made him read it back to me. He said he’d drop in in the mail. Ok, so now it’s been over a week since that phone call. I’m getting the feeling he’s not going to pay us. Right now he’s paying 2 mortgages (one for his house in Ma, and another one for the Long Island house), and I think he can’t afford to pay us. What on earth do we do next? Sue? How much longer should we wait? I am frustrated and at a loss!
